Abstract [eng] The development of the food technology has led to the appearance on the market of an ever-widening range of novel foods. Among all the novel food products, especially the genetically modified food has acquired a special attention and even a harsh hostility in the society. The legislators, also the Community legislature are thus facing a necessity to ensure the safety of such food and to balance different economic and social objectives, such as promotion of innovation and competitiveness of industry, protection of health and consumer preferences. This Dissertation analyses legal problems, raised by the specific issues of the complex EC GM food regulation regime and its application by the Community institutions and in the Member States in the light of its effectiveness and credibility. The legal debate is focused on the number of problems related to the use of the scientific data in the GMO regulation and risk management, especially to the legitimacy and transparency of risk regulation, and to the proper guaranties of the consumer choice. Specific issues of the GM food regulation are examined in the context of developing EC food law, covering also the influence of the national and the international regulatory levels.
