Abstract [eng] The freedom of expression is one of the most fundamental human rights. The Constitution of the Republic of Lithuania and the laws provide satisfactory protection of freedom of expression. There are presented the laws, wich regualte freedom of expression. Also there are presented main problems of impelementation of this freedom in this article. The auther analizes the practice of the Contitutional and Supreme Courts of Lithuania. Despite widespread recognition of this principle, it is generally accepted that some restraints are necessary and desirable where are conflicts with other fundamental human rights. The freedom of expression is restricted right. The restriction is possible and permissible only when it is necessary in a democratic society to protect essential worths, secondly, it is fixed in laws. The freedom of expression ensures tolerance and democraty also pluralizm in democratic society. It helps to express yourself as individuality, to comunicate with other people, to debate, express your opinion and ideas in press or television. So interference must by provided for and carefully defined by law.
