The content of the guarantees of the career civil servant granted according to the legal status and public administration activities, and practical implementation of the aforementioned guarantees are analysed in the Dissertation, evaluating such guarantees by the sufficiency or insufficiency of the legal regulation. The research by simultaneously using theoretical and empirical research methods covers: the analysis of the civil service conception, bearing in mind the links with the public administration and public service definitions, the analysis of the civil servant definition, enabling answer to the question, who should be treated as a civil servant, and the identification of the peculiarities of the civil servant status. This research provides a definition of the career civil servant guarantees, in order to determine specific guarantees to the career civil servant and its classification. While providing analysis of the particular guarantees of the career civil servant, the content of the career civil servant right to the fair remuneration for the done work in line with the implementation challenges and case – law of the Constitutional Court and other courts evaluation, and the content of the remuneration compensatory allowances and its safeguarding were examined. The content of the guarantees related to the upholding the post held by the career civil servant and their granting, according to the certain conditions in assessment of its sufficiency or insufficiency to the particularity of the status of the career civil servant was analysed. Also, the content of the guarantees related to the end of the service and their granting in assessment of its sufficiency or insufficiency during practical implementation. |
