| Abstract [eng] |
The dissertation is on the subject matter that has not been researched in Lithuania yet, i.e. the principle of duty to cooperate, application of this principle and its significance in legal contractual construction relations. The paper presents the analysis of the main rights and obligations of construction contract’s parties in details; the analysis is carried out in amount, necessary to reveal the application of the principle of duty to cooperate and its significance in legal contractual construction relations. It is reasoned in the dissertation that the principle of duty to co-operate is a common principle of contracts law, and it cannot be interpreted only as the expression of the principle of good faith and fair dealing. The legal doctrine in Lithuania does not embody the rules for the implementation of the principle duty to cooperate, but these rules are created in foreign legal doctrine, and the dissertation opens the possibility and necessity of the use of these rules in Lithuania. The elements of the content of the principle of duty to cooperate that were purified in the dissertation might facilitate appropriate appliance of the civil liability for the violation of the principle duty to cooperate in the construction contractual relations. The author also proposes the changes to legal regulation re due implementation of duty to cooperate in construction contractual relations. |
