Abstract [eng] Definition of act of terrorism according to the Penal code of Lithuania, criminal laws of foreign states and international law Summary At the 2000 – 2003 the Seimas of the Republic of Lithuania adopted a range of new legal acts according to the purpose of implementation of international legal instruments in the national criminal law. In the work the author analyses criminal elements of terror act in the Lithuanian Penal code and in the international legal instruments against terrorism as well as in the national criminal law of foreign countries. The author establishes main problems that occur in the process of qualification of terror act. Also in this work considering the implementation of international rules in force according to the Penal code of the Republic of Lithuania author comes to a conclusion that international provisions is transferred successfully. In the work author establishes the concept of terror act as one of the most dangerous offences witch means the placing of explosives with the intent to cause explosion, cause of explosion or fire to in a place of dwelling, work, gathering or a public place also spreading of radioactive, biological or hazardous substances, preparations or micro-organisms. The essence of terror act is that this offence is related with endangerment of public safety, the human life, health and property. The objective elements of terror act leads to the endangerment of many people lives or health. The analysis of international legal acts shows that there is no legal definition of terrorism. Therefore international conventions in the fight against terrorisms deal with a specific forms or terrorism. In the work author analyses the criminal laws of foreign states and comes to the conclusion that terror act is criminalized differently in each state. This is because each state has a right to choose the way of implementation of international legal acts in their national criminal law. In the work author also considers qualifying elements of terror act, analyses the problems that may occur when implementing the article 250 of Criminal code of Lithuania in the practical area. Author analyses the regulations of liability for terror act when it committed in accomplice, considers the concept of terrorist group.
