Abstract [eng] The object of the present research is criminal liability for illegal abortion and compelling a woman to have it. In the first part of the Dissertation, abortion is analyzed in the medical and religious aspects – both the medical concept of abortion and the position of Catholic Church in respect of abortion are considered. In the second part of the Dissertation, the incidence of legal and illegal abortion in Lithuania as well as the causes of abortion are analyzed. In addition, in this part a detailed analysis of the development of criminal laws regulating criminal liability for illegal abortion in Lithuania is provided and the problems of existing legal regulation of abortion are disclosed. In the third part of the Dissertation, the constituent elements of crimes provided for in Article 142 (“Illegal Abortion”) and Article 143 (“Compelling a Woman to Have an Illegal Abortion”) of the Criminal Code of the Republic of Lithuania are examined in detail. In the last (the fourth) part of the Dissertation, the criminal legal consequences that shall arise to the persons who have committed the crimes under discussion are analyzed. In this part, a particular attention is paid to the structure of the sanctions provided in the Articles 142 and 143 of the Criminal Code of the Republic of Lithuania as well as to conformity (proportionality) of the penalties provided in them to the dangerousness of the crimes under discussion.
