In this work it is analysed the concept of suretyship insurance contract, rights and duties of the parties of this contract as well as rights and duties of other concerned persons (beneficiaries). The concept of suretyship insurannce is revealed by comparison with similar institutions- suretyship as an ensurement of performance of obligations, credit insurance and civil liability insurance. Afterwards it is introduced essential conditions of suretyhip insurance contract, bearing in mind the peculiarity of suretyship insurance. It is analysed in a detail matter concrete rights and duties of insurer, insured and beneficiary, arising from Civil code, Law of Insurance and standard terms of the contract (insurance rules). It is discussed pre-contractual rights and duties as well as rights and duties of contract of suretyship insurance, including but non restricting to duties and rights after the insured event. As there are no special rules, regulating suretyship insurance contract, it is asessed theoretical and practical possibility to apply general provisions of insurance contract, particularly from the position of insurer. In this work, inter alia, is introcuded analysis of real and theoreticallly possible practical situations. |
