This work covers conclusion and performance of one of the most actual business relationship. Lease is a mutual benefit – it is an opportunity for the object owner to increase benefits generated by the object, especially in case when its own forces, and risk is not intended to use the object, and for the tenant it is an opportunity to develop its business with the minimum investments. The benefit created because of a such business strategy of the lease relationships, which rapidly has a growing place in the society, determines the actuality of this theme. The work covers the peculiarities of conclusion and performance of commercial real estate lease agreement by ascertaining the essential elements of such a transaction: object, subjects and other necessary conditions for validity of such a transaction, taking account of the sort of certain real estate object and accordingly it‘s formalion process. This work analyzes the interaction between the common rules of law, which regulates the lease relationships, and specific rules of law, which regulates particular real estate lease relationships. Finally, the work is summarized in the conclusions, which reflect the specific aspects oh this theme and help the parties of lease relationships to understand the essence of the transaction and to conclude the rights and obligations, in order to enter the stability in such a relationship and avoid negative consequences. |
