In the beginning the work, which is called „Punishability of abortion“, produces the review of the right to life concepts. In this work there is also said about international law‘s position of feotus right to life on the basis of international organizations conventions of human rights and their interpretation and the cases of European Court of Human Rights. The work provides the analysis of the right to life of Lithuanian law enforcement. The rezult of analysis is compared with other countries. Because the abortion is known as a crime since ancient times, Lithuanian laws, which criminalize abortion, evolution‘s review is very important. The subject of the work "Punishability of abortion" implies an obligation not only to review the law, which establishes responsibility for illegal abortion, but also to review the conditions under which the pregnancy is allowed to terminate. In the third part of this work there is said about legal abortion procedure and the operation conditions in Lithuania. This work is also focused on the abortion in medical practice, discussing not only the abortion methods, but also the consequences of this operation. The most significant part for theory of criminal law is the analysis of illegal abortion as a crime, provided in the Criminal Code. The elements of illegal abortion are analyzed in greater detail, when illegal abortion is separated by the elements from other crimes. |
