The object of the master work is the composition of smuggling. The main puspose of this paper is, according to the acts of law, doctrine, and court practice, to analyse thoroughly the elements and features of the composition of smuggling crime and to look into the main problems of qualification. In the first part of this paper smuggling crime, its reasons and maleficence are defined. Also the development of law acts of Lihuania, which finetune smuggling crime, is analysed. In the second part of this paper the elements and features of the main composition of smuggling are thoroughly scrutinized. To say more, some examples of smuggling qualification are analysed. Furthermore, the main problems of smugglung qualification are disputed. The qualificatory features of smuggling crime are analysed in the third part. The problems of qualification according to court practice are also disputed. According to the acts of law and court practice i delimitated smuggling crime from smuggling administrative tragression and another similar crimes in the fourht part of this paper. The acts of law of Russia, Ukraina, Latvia, Finland and Sweden were analysed in the fifth part of the master work in purpose to review the expression of the smuggling crime in these countries. |
