In the present Master’s work, there is analysed the institute of legal status of convicts, its historical development and factors, making influence on the contents of the present institute. There is revealed in detail the concept and the structure of legal status of convicts in the theory of penal law, laws and in different scientific studies of Lithuania and of Russia. Also, there are provided suggestions regarding possible improvement of the definitions of legal status of convicts. Plenty of attention is assigned to analysis of national and foreign and international law acts regulating implementation of punishments, considering their relationship with personal rights, freedoms and duties of the convicted people. There are also provided suggestions regarding improvement of contents of some national law acts. In different chapters of the work, there is revealed the impact of contents of legal status of convicts and its implementation forms on the processes of implementation of punishments and re-socialisation of convicts. Also, there is provided assessment of criminal conduct by other branches of science – criminology, sociology and psychology. Such assessment is especially important consolidating legal status of convicts, organising their rehabilitation and adaptation, when they return to free life. |
