Abstract [eng] |
Humanitarian intervention is a contraversial concept of international law doctrine because of its compatibility with the principles of state’s sovereignty and non - use of force in the contemporary international law. The Dissertation is intended for a systematic analysis of the concept of humanitarian intervention and its legality problem in order to provide coherent concept of humanitarian intervention in contemporary international law. This is one of the first efforts in the international law doctrine to reflect the evolution of humanitarian intervention concept taking into consideration the new concept of responsibility to protect and by doing that to solve contradictions surrounding the concept of humanitarian intervention. After analysis of the concept of humanitarian intervention and its legality problem, the author tries to establish the influence that the new responsibility to protect concept has on the authority of UN Security Council and regional organizations. The author aims at revealing progressive development of international law and provides alternatives for solving legality problem of humanitarian intervention not authorized by the UN Security Council. Practice of regional organizations could have decisive influence on the evolution of a new international custom relating to the right of unauthorized humanitarian intervention in order to implement responsibility to protect of the international community when UN Security Council fails to do it. |
