Abstract [eng] This work covers conclusion and performance of one of the most actual business relationship. Rejection of investments in the fundamental resource of almost all of business sorts, also evaluating the enormous outgoings for formation of such a thing, and selection of alternative by using the estate of essential gravity for execution of business activities and paying periodical contributions to third persons, suggests effective operation of finance. Undeniable benefits of such relationship and its distribution in society determines the actuality of this theme. The work covers the peculiarities of conclusion and performance of commercial real estate lease agreement by ascertaining the essential elements of such a transaction: object, subjects and other necessary conditions for validity of such a transaction, taking account of the sort of certain real estate object and accordingly it’s formation process, as well as the form of property, whether it is private or public, including the requirements for the content of such a transaction, as well as form of conclusion and consequences of departure from it. This work analyzes what effect the real estate object has on execution of common rules of law and what is the bearing amongst them and certain specific rules of law. Eventually, the work evaluates what is the influence of public law on content of certain relationship and altogether the relationship of the lessee as a person, who acquired the essential usage right, with third persons. The work is being summarized with findings, which should help the parties of such widespread relationships to understand properly the essence of the transaction and to conclude on rights and obligations in order to escape the negative consequences while concluding or performing the transaction.
