Abstract [eng] The purpose of the doctoral dissertation is to reveal the meaning of the concept of the employment contract, its relationship with some other legal forms of work, discuss a few examples from each of the most characteristic forms of work, as well as find out whether the existing legal regulation of labour relations and other legal relations is suitable and adequate highlighting major practical issues arising due to the delimitation between legal relations based on the employment contract and other legal relations which do not constitute legal relations of labour although they are related to work. The dissertation consists of the introduction, three chapters, conclusions and recommendations. Chapter One analyses the concept of the employment contract; Chapter Two covers legal relations, regulated by the provisions of special law, i.e. (a) civil service, (b) employment of sentenced persons; Chapter Three deals with the legal forms of work in the area of regulation of civil law, i.e. first of all, a general analysis of employment and civil agreements is presented, followed by a study of the employment contract and the relationship between several most characteristic and most often used in practice agreements – a contracting agreement and an authorship agreement, as well as an agreement regarding management of a legal entity. It is concluded that employment contract is an autonomous contract type, but the employment contract is not the only form to legitimise the legal relations of the parties regarding work. The employment contract should formalise employment relations and it may not be used to formalise civil legal relations at the discretion of the parties.
