The topic of this Master's thesis is criminal liability for smuggling. The thesis is based on the legislation of the Republic of Lithuania, the doctrine and the practice of national courts. It deals with the criminal liability for smuggling under Article 199 of the CC, but also Articles 2532, 2562, 2601, 2661, 2672, 2673 and 2674 of the CC. The Master's thesis presents the concept of smuggling, the main reasons for the spread of smuggling in Lithuania, and discusses the dangerousness of the offence not only for the economic system, but also for other state goods. The evolution of smuggling laws in Lithuania is discussed, and the reasons for the changes in the regulation are outlined. It highlights the changes to the regulation of smuggling which came into force on 1 June 2023. It also analyses the main elements of the composition of smuggling: the object, the objective side, the subject and the subjective side. The specific features of smuggling are discussed separately and the concepts relating to them are clarified. Various examples of the qualification of smuggling are given on the basis of case-law. The different cases of criminal liability, the penalties applicable to the perpetrator in the case of smuggling, and how they differ from the previous legislation on smuggling articles are examined. |
