Considering January 1, 2020, amendment of the Republic of Lithuania's Law on Patient Rights and Compensation, it is relevant to assess the knowledge, opinion and experience of Lithuanian residents regarding the compensation model that is applied to patients who suffer health damage while receiving health care services. Scientific literature articles usually discuss the theoretical and practical implementation of the no-fault model in various countries, comparing the advantages and disadvantages of the variants of this model, however, there is a lack of scientific studies scientifically based on how patients themselves assess their right to receive compensation if their right to receive quality and safe healthcare service is violated. The aim of the study - To evaluate patients' knowledge and opinion about their right to receive compensation for damage caused to their health based on the no-fault model. Study objectives: 1. To evaluate patients' knowledge of the no-fault compensation model for health damages. 2. To evaluate patients' opinions about the benefits of the no-fault health damage model, realizing their right to health damage compensation. 3. To reveal the experiences of patients who have suffered health damage in a medical institutions and seek to receive compensation based on a no-fault model. Research methods: Quantitative research methodology was applied, conducting an anonymous survey. 127 respondents participated in the study, of which 90 (70.9%) were women and 37 (29.1%) were men. Research data was processed using SPSS 26.0 statistical software. Quantitative survey data were analyzed using descriptive and analytical statistics. To evaluate the differences between the groups formed during the analysis, hypothesis testing was performed, calculated according to the Pearson Chi-square (χ²) criterion. The chosen level of statistical significance is α = 0.05 and the differences are considered statistically significant when p ≤ α. Results and conclusions: Many respondents (56.7%) had no information about the no-fault compensation model and would like to know more about the essence of the model. Male respondents are more aware of the no-fault model than female respondents. More than half of the respondents (58.7%) agree that the no-fault model is beneficial for patients and almost half of the respondents (47.2%) see the advantage in the fact that the patient is compensated for the damage without his obligation to prove the doctor's fault. More than half of the respondents (52.8%) stated that they had an experience when their health was harmed during the provision of health care services. Almost half of the respondents (46.3%) are convinced that the damage was caused by the negligence and carelessness of the doctor. More than half of the respondents who, in their opinion, suffered health damage, did not apply for compensation because they did not know where to apply. |
