The limited pecuniary liability of employees is concerned as an independent legal liability in Lithuania which one of the main purpose is to protect pecuniary interests of employees. Despite of this legal regulation there is no unanimous opinion if the limited pecuniary liability of employees is independent. In this master thesis the author deals with the concept of the limited pecuniary liability of employees. Also there is a categorisation of limited and full liability, individual and liability of group presented and discussed. Special attention is paid to the analysis and the comparision of conditions of the limited pecuniary liability of employees and the civil liability because these liabilities are similar of their pecuniary nature and the purpose to compensate the damages. The aim is to purify the similarities and differences of their conditions. As well as the exemples of legal regulation of these relations of The Russian Federation, Germany and France are given. Furthermore, the author gives the determination and compensation of damages and identifies the litigation before the court and in the court. As one of the most important sources used in the thesis is the jurisprudence of the Lithuania Supreme Court which provides most of the answers to the problems. |
