The purpose of master‘s work is to analyze bankruptcy trustee liability, as subject of bankruptcy process, his or hers executed duties, functions, other aspects of bankruptcy trustee’s functions and connections with civil liability. Bankruptcy trustee liability is analyzed in master’s work, first of all, presenting bankruptcy law, the importance of bankruptcy and the process of bankruptcy and impact to economical and legal system in the Republic of Lithuania. Also the main features of bankruptcy trustee‘s institute are discussed, presented problems related with bankruptcy trustee‘s role in disputes in relation with his or hers duties, rights and civil liability. In this work presented legal acts of the Republic of Lithuania, which regulate rights and duties of bankruptcy trustee, demanding criteria for bankruptcy trustee position, the regulations of insurance of civil liability, analysis, examples of court practice related with bankruptcy trustee‘s civil liability and its problematic situation for lack of determination in legal acts. There are presented explanations in analyzed court cases for harmful actions of bankruptcy trustee according to regulations of Civil Code of the Republic of Lithuania, presenting explanations in situation where harm appears and compensation questions for executed harmful actions. The institute of bankruptcy trustee in the Republic of Lithuania is compared with foreign countries: the Republic of Latvia, the Republic of Croatia and United Kingdom of Great Britain and Northern Ireland, institutes executing functions in administration process in bankruptcy procedure. These countries are compared according to equal criteria and comparisons are presented in appendix. The conclusions of analyzed topics are presented in the final part of master’s work. |
