This master's thesis analyzes criminal liability for the possession of pornographic material in which a child is depicted or a person is presented as a child, as defined in paragraph two and three of Article 309 of the Criminal Code. The thesis explores the concepts of pornography and child pornography. It also examines the development of legislation in Lithuania regarding criminal liability for the possession of pornographic material involving the depiction of a child or a person presented as a child, and identifies the factors that have influenced changes in legal norms. The study further analyzes the composition of the criminal offense and the qualifying elements related to the possession of such material. In addition, the thesis reveals the problematic aspects that courts encounter when qualifying alternative acts provided for in paragraph two of Article 309. Furthermore, judicial practice is examined in order to determine the types of penalties imposed by courts for the offenses defined in paragraphs two and three of Article 309 of the Criminal Code. |
