The master's thesis analyzes the realization of the goals of punishment when serving a prison sentence. The topic is explored by discussing classical theories of punishment, the historical context that influenced the formation of the Lithuanian concept of punishment, and the interpretation of punishment currently presented in legal doctrine. The thesis further analyzes the goals of punishment established in the Criminal Code in order to reveal possible perspectives for improving the criminal law. The thesis argues that the stage of sentencing also influences the execution of the sentence, however, different goals are pursued during these stages, therefore they should be properly delimited in the law. Further, in order to define the implementation of the sole goal of the law of execution of sentences – social integration – when serving a prison sentence, such important factors as the individualization of resocialization, employment, studies, leisure activities, the prevalence of addictive diseases and their treatment options, the opening of imprisonment, and the domestic conditions of imprisonment are analyzed in detail. The paper discusses the reform of the concept of resocialization and the prison modernization project in order to reveal whether real changes are taking place in the Lithuanian system in order to implement international standards and recommendations. In order to determine whether these changes are not merely formal, not only legal acts but also statistical data are discussed. |
