The master's thesis analyzes the diversity of concepts of restorative justice, examines the implementation of restorative justice in the probation process and its legal regulation. It provides an overview of the international and European Union legislation that gave rise to and impetus the spread and development of the Institute of Restorative Justice. At the beginning of the work, the variety and forms of concepts of restorative justice (also called models in some sources) are analyzed. The purpose and constituent elements of restorative justice are also clarified. The work analyses three main forms of restorative justice – mediation, conference and round table discussions. The main focus of the work is on revealing the implementation of restorative justice in the probation system. International and European Union legislation that establishes the principles of restorative justice and the possibilities of implementation are analyzed. A subsequent review of national legislation regulating the use of forms of restorative justice. |
