Abstract [eng] This master's thesis analyzes and presents the criminal legal and forensic characteristics of rape and sexual assault, the knowledge of which allows for proper assessment, qualification of these crimes, and successful planning of the investigation. The first part of this work analyzes the criminal legal and forensic characteristics of the criminal acts of rape and sexual assault. Also, in order to reveal the criminal legal and forensic characteristics of these criminal acts, the relevant practice of the Court of Cassation and lower courts is presented. In the second part of this work, after analyzing the features of the disclosure of these crimes and planning their investigation, the main typical investigation situations and the main typical investigation versions are presented. Specific investigation actions are performed depending on the investigation situation and the investigation versions raised. After analyzing the practical material of criminal cases, the most commonly performed initial and further pre-trial investigation actions are presented. The third part of this master's thesis analyzes the following pre-trial investigation actions that are most commonly performed when investigating rape and sexual assault: interrogations of witnesses, suspects, victims, examination of the victim and suspect's body, inspection of the scene of the incident, verification of testimonies on the spot, inspection of objects, investigation, expert examinations of the victim and suspect's mental state. When performing these actions, investigators often do not comply with the requirements of criminal laws and make mistakes.
