The Master's thesis analyses the performance of notarial acts remotely, using the legislation of the Republic of Lithuania, comparing it with the practices of Latvia and Estonia and conducting a qualitative research (survey). Remote notarial actions are regulated by the Law of Notarial Profession of the Republic of Lithuania, defining the procedure of their performance. The specifics of remote actions, their practical advantages and challenges, the functions and legal requirements of the related elements, technological solutions and future trends regarding the prospects of digital notarial are revealed in the analysis of this topic of the master thesis. The work deals with the principles of the legal status of the notary, the functions entrusted by the state, the ethics of professional activity. It also defines the types of electronic signatures, their legal force, and provides an overview of legal acts that regulate remote notarial acts. The current legal framework in Lithuania is compared with that of Latvia and Estonia, their similarities and differences are outlined, as well as the ways of dealing with threats related to data protection and cyber security. In order to reveal the topic, the technological solutions necessary for the implementation of remote actions are discussed, qualitative research was conducted to find out the advantages and disadvantages of remote notarial actions and to provide recommendations for their more effective implementation. Finally, the technological instruments and their application in the notarial system of the future are presented. The Master's thesis allows to draw conclusions on the current legal regulation of remote notarial actions, the challenges arising when providing services remotely. The conducted survey provides a more detailed insight into the problems of remote actions and notaries' attitude towards it. Due to the technological changes taking place all over the world, it can be expected that the newly developed tools will complement the notary and contribute to its further digitization direction. |
