All parties to the conflict must respect and ensure compliance with IHL standards. Unfortunately, today's hybrid conflicts involve brutal violations of international humanitarian law, affecting its very essence – the principles that confirm one thing: hybrid conflicts pose a threat to the IHL protection mechanism, which is evident both in the failure to comply with international humanitarian law and in violations of its principles, and there is a clear correlation with a lack of respect for the IHL mechanism itself. One of the main challenges in the context of hybrid conflicts is the complexity of classifying conflicts. The analysis of historical conflicts in this work has shown that hybrid warfare is not a new phenomenon and has revealed the diplomatic aspect of armed conflicts. However, modern conflicts often do not fit within the strict traditional legal boundaries that define the nature of an international or non-international armed conflict, and the complexity of classifying conflicts becomes one of the main problems that hinders the application of THT norms, which affects the principles and threatens the protective function of IHL. The analysis in this paper shows that hybrid conflicts clearly influence treaties and, therefore, diplomacy, as treaties are one of the essential components of diplomacy. |
