| Abstract [eng] |
The foregoing analysis has demonstrated that the role of a vehicle in the crime of driving under the influence is understood differently in Poland and Lithuania. Under Lithuanian law, the forfeiture of a vehicle is mandatory in principle, whereas under the Polish Crim-inal Code it has been discretionary since 29 January 2026. Both legal systems specify cases in which the forfeiture of a vehicle is not permissible. |
