Concept of Rule of Law in the Light of Article 7 of the Treaty of the European Union. Concept of Rule of Law in the Light of Article 7 of the Treaty of the European Union. The concept of the rule of law is usually divided into formal and material concepts. However, considering the events in the world's history, it was highlighted that in the reality, the formal concept of the rule of law is not enough. The accession and foreign policies of the European Union reflect the prevailing material conception of the rule of law, as the rule of law is inextricably linked to democracy and the protection of human rights, which are the material elements. The creation of prevention and sanction mechanisms, provided in Article 7 of the Treaty of the European Union, have reaffirmed the existence of the material concept of the rule of law in the European Union, and hence in the context of the Article 7 of the Treaty of the European Union. |
