This master’s thesis examines the criminological and criminal law aspects of smuggling in Lithuania and Europe. Smuggling is viewed as a complex phenomenon that not only violates established procedures for transporting goods across state borders but also harms the state’s economy, financial system, fair competition, public safety, and the public interest. The thesis explores the concept and historical development of smuggling, analyzing the criminological causes and conditions of this phenomenon related to Lithuania’s geographical location, excise tax policy, price differences between countries, organized crime, and other social and economic factors. It examines the characteristics of smuggling actors, the scale and trends of smuggling in Lithuania and Europe, as well as the impact of this criminal activity on society, the economy, and national security. The paper discusses that the smuggling of excise goods, particularly cigarettes, remains particularly significant in Lithuania, while drug smuggling is characterized by growing trends. The section on criminal law aspects analyzes the criminalization of smuggling under Lithuanian criminal law, the types of smuggling, aspects of distinguishing between administrative and criminal liability, and a comparison of Lithuanian legal regulation with models in other countries. The paper also assesses the role of national and international institutions in the control and prevention of smuggling, emphasizing that effective curbing of this criminal activity requires not only criminal law measures but also a consistent prevention program, inter-agency cooperation, and a systematic state policy. |
