The master's thesis analyzes the system of disciplinary sanctions for prisoners in Lithuania and other European Union countries, examining both relevant legislation and conclusions made by academics in doctrine, as well as explanations provided in court practice. The system of disciplinary sanctions for prisoners is revealed by analyzing not only theoretical aspects, such as the concept, functions, objectives, and types of disciplinary sanctions, but also by analyzing the procedure for imposing and enforcing disciplinary sanctions, while also discussing relevant statistics on this topic. The paper defines the concept of disciplinary sanctions, establishes their functions and objectives, emphasizing that disciplinary sanctions ensure security and order in prisons, but do not serve the purpose of resocialization. It also examines the procedure for imposing and enforcing disciplinary penalties, highlighting the most important stages of the disciplinary sanctioning process, such as the identification and recording of violations, which is considered an essential basis for the further disciplinary sanctioning process, the imposition and enforcement of disciplinary sanctions, and emphasizes the need to ensure the fundamental rights of detained or convicted persons during this process, such as the right to be informed, the right to have a defense counsel, and the right to appeal, considering these rights as a counterbalance to institutional power, and the related issues. It should also be noted that when examining certain aspects of the legal regulation of disciplinary penalties in Lithuania, a systematic comparison with other European Union countries is conducted, thus highlighting the specifics of the disciplinary penalty system. The effectiveness of disciplinary sanctions is also discussed, emphasizing the detrimental effect of disciplinary sanctions, especially isolation, on prisoners' behavior and mental state, as well as the influence of the relationship between prison officers and prisoners on the need to apply disciplinary sanctions. |
