The master's thesis analyzes the topic of car theft investigation by examining legal acts, the conclusions of scientists in the doctrine, and case law. The analyzed topic is most clearly revealed through the prism of the implementation of pre-trial investigation actions established in the Code of Criminal Procedure. Examining this topic of the master's thesis reveals that car theft is a relevant law enforcement problem, and the investigation of car theft is an important task of responsible police officers. The work analyzes the concept and criminal legal characteristics of car theft, as well as the forensic and criminological characteristics of car theft. The work analyzes the features of car theft detection and investigation planning, which are revealed in the provisions of the Criminal Procedure Code, doctrine and case law. The features of car theft detection and investigation planning are analyzed by analyzing the importance of the initiation of a car theft investigation, criminal intelligence, search and other necessary actions, and cooperation with foreign officials for the course of the pre-trial investigation. The topic of the work clearly distinguishes typical investigation situations and versions and the main investigation actions. The analysis of the methodology for performing individual process actions reveals the significance of the inspection of the scene of the incident, interviews of the victim (applicant) and the suspect, examination of testimonies at the scene, identification of testimonies, expert examinations and searches in investigating car thefts. The problems of investigating car thefts revealed by the analysis of case law and statistical information show that despite the decrease in the number of car thefts, their investigation rate still remains low. The amendments to Articles 178 and 190 of the Criminal Code made in 2023 are also relevant, and will have a significant impact on case law in applying criminal liability for car thefts. |
