This thesis undertakes a comparative analysis of the protection of freedom of expression as a fundamental human right in India and Europe in the context of social media regulation. It examines the legal frameworks under Article 19(1)(a) and 19(2) of the Constitution of India and Article 10 of the European Convention on Human Rights, as applied through the Human Rights Act 1998, along with statutory and common law limitations. The study evaluates the balance between freedom of expression and competing rights such as privacy, reputation, and public order in digital communication. It also considers the regulatory role of social media platforms in moderating online speech and the legal implications of private content governance. The research incorporates questionnaire-based empirical findings, highlighting challenges in the enforcement of online speech rights. It identifies differences in the scope and application of restrictions between the Indian and European legal systems while emphasizing a shared objective of maintaining constitutional balance in a democratic framework. |
