In the Master’s thesis is analyzed the institution of testimony verification procedures, which encompasses such independent criminal procedure actions as identification, on-site testimony verification and investigative experiments, all of which are intended to verify the reliability of evidence and establish the relevant circumstances relevant of the case. These procedures aim to confirm or refute a person’s connection to a criminal act, assess the consistency of testimony with the factual situation and determine the possibility of certain circumstances under specific conditions. The concept of testimony verification actions is examined through an analysis of their historical development and by comparing them with the doctrine of criminalistics in the Federal Republic of Germany, as analogous procedural actions are not codified in the legislative acts and of the Italian Republic, where these procedural actions are established in a similar manner. In the thesis analyzing legal and academic literature, reveals the objectives of testimony verification actions, their procedural forensic characteristics and the legal and tactical challenges of their practical application. Drawing on the case law of the Supreme Court of Lithuania and lower courts, problematic aspects of testimony verification actions are highlighted, and proposals are presented, aimed at improving procedural requirements and supplementing recommendations of criminalistic tactics in order to ensure an objective and comprehensive investigation of the case, contributing to the reliability of evidence and creating the preconditions for the adoption of a well-founded procedural decision. |
