The Implementation of the Prohibition on the use of Chemical Weapons Master thesis analyses the use of chemical weapons prohibition implementation in accordance with international law. This thesis is essential for international law as it seeks to provide a comprehensive and relevant analysis of the prohibition of chemical weapons, its regulatory aspects and existing practical issues. This thesis seeks to describe the concept and the characteristics of a chemical weapons in detail. Review its use throughout history, analyse the first attempts to regulate the prohibition of chemical weapons, as well as contemporary regulation in conjunction with regulatory actors and practical difficulties. In the beginning the thesis reviews general aspects of chemical weapons and previous attempts to regulate the prohibition of chemical weapons. The second part introduces valid international agreements on the prohibition of chemical weapons, analysing their structure, object of regulation and the matter of subject. The third part provides an overview of the role of international organizations and other international actors in the prohibition of chemical weapons indicating their functions and mandates. Finally, the last part analyses the practical issues of the use of chemical weapons are discussed, examining the interaction of organizations and conventions, analysing jurisprudence, and the latest and most relevant events on the use of chemical weapons. The main sources of this thesis are conventions and international agreements, such as the Protocol for the prohibition of the use in war of asphyxiating, poisonous or other gases, and of bacteriological methods of warfare, Convention on the prohibition of the development, production, stockpiling and use of chemical weapons and on their destruction, Rome Statute of the International Criminal Court, as well as scientific literature and documents of international organizations. |
