Abstract [eng] Fashion is one of the biggest and fastest growing industry in the world. However, despite the social meaning of fashion to the society and the huge numbers of production and creative products, intellectual property rights of fashion designers are still often violated. Therefore, the key objective of this master thesis is to analyze the existing legal protection and remedies of design in fahion industry and to evaluate the prospects of legal protection of design in fashion industry in the Republic of Lithuania. This master thesis consists of five main parts. Definition of design in fashion industry is discussed in the first part. The second part is dedicated to the analysis of the significance of legal protection of design in fashion industry – it examines the historical development of legal protection of design in fashion industry, as well as different views for the necesity of this kind of legal protection. The third part explains most common types of infringements of intellectual property rights in fashion industry. The fourth part is dedicated to detailed analysis of specific types of legal protection and remedies of design in fashion industry – peculiarities of design rights, copyrights, trademarks and patents regarding legal protection of design in fashion industry are discussed in this part. The fifth part contains theoretical insights about the prospects of legal protection of design in fashion industry in the Republic of Lithuania. Moreover, this part examines the results of an investigative interview with two famous lithuanian fashion designers – Ramunė Piekautaitė and Robert Kalinkin.
