Corpus Delicti of Threatening to Murder or Cause a Severe Health Impairment to a Person or Terrorisation of a Person (CC Article 145) This master’s thesis analyzes the Lithuanian Criminal Code Article 145 provided for a criminal offense - threating to kill or severely impair human’s health or human’s harassment. The aim of this work is to provide a comprehensive analysis of the corpus delicti of this crime. The first part of this master’s thesis reveals mental abuse in the concept of criminal law science. It analyzes characterizing features of mental violence in definitions of mental abuse presented by scientists. It also investigates a threat to kill or severely impair human’s health or human’s harassment corpus delicti in the historical development of Lithuanian law. The second part of this work details analysis of the corpus delicti objectives elements - the object, the victim and the deed - paying greater attention to the reality of the threat, the content of sufficient reason, mental abuse continuity, systematic. It also includes subjective elements - the subject and fault analysis. The third part of this master’s thesis analyzes a threat to kill or severely impair human’s health or human’s harassment corpus delicti of Latvia, Estonia, Poland, Russia, Germany and France criminal law. It also highlights the differences and similarities between the countries mentioned and the Lithuanian Criminal Code Article 145 provided for the offense. |
