Analysis of Corpus Delicti of Authorship Misappropriation This article analyses corpus delicti of authorship misappropriation as well as problem aspects of its legal qualification related to the elements of the crime. The quality of legal regulation in Lithuanian Criminal code of authorship misappropriation and the system of crimes against intellectual property in general, is evaluated using national doctrinal, practical, historical and comparative analysis of various foreign countries’ criminal laws. Article also analyses historical development of disposition of authorship misappropriation from Tsarist Russia times to the present day, hitherto never separately analysed by the criminal law doctrine. Lastly, the article presents criteria of dissociation of authorship misappropriation and similar criminal offenses and other violations of law. |
