The chosen topic of a master thesis is ,,Liability issues of preparation to commit a crime in criminal law of Lithuania and European Union“. It reveals the subject of a research – stage of preparation to commit a crime in criminal law of Lithuania and European Union. The author focuses not only to analysis of punishability of preparation stage in Lithuanian criminal law, but also to the reflection of European Union law provisions relating to this preparatory stage of criminal offense in national criminal law. The study starts with characteristics of a common preparatory stage of criminal offense – preparation to commit a crime: revelation of description and content characteristics, as well as analysis of their common features. The first part of the thesis focuses on analysis of dissociation of preparatory actions from ,,intent publicity“, as well as connections with voluntary withdrawal to complete the criminal offense. This part of the thesis analyses the main similarities and differences of actions of preparation and other preparatory stage of criminal offense – attempt. It also discusses the problematic issues of criminal responsibility realization for preparation to commit a crime. The second part of the thesis examines the significance of European Union legislation to the national institutions of criminal law and analysis of particular case - stage of criminal offense – preparation to commit a crime. In the context of researched topic, the author focuses to implementation of European Union legislation in specific norms of national criminal law. It also emphasizes that the influence of EU law to the institution of criminal offense stage poses or may pose serious problems by law making. The third part of the thesis reviews the regulation of preparation stage in foreign criminal laws in comparison with the national criminal law. |
