| Abstract [eng] |
The new civil code reformed national civil law by the reception of the law of the number ot jurisdictions. It had adverse effect on the coherence of the civil law. The analysis of emphyteusis and contractual lease reveals that such problem also exists in respect to abovementioned rights. This article analyses character of emphyteusis and contractuat lease, qualification criteria and legal consequences of such qualification as well as provides for the recommendations for the improvements of legal regulation. |
