Establishment of a business transfer is a result of a comprehensive analysis of the features that identify business transfer. Both a number and a scope of those features are in a process of constant change due to the case law developed by the Caurt of Justice. The weight of such features in every particular situation is different, as well as the complexity af their identification. However, the crucial focus should be made on the establishment of "identity" of the transferred economic entity. This article discusses the origin, significance, conception and contents of the lecture of identity. |
