Abstract [eng] The article deals with the general aspects of the concept, legal regulation and practical implementation of the prosecutorial discretion of the Prosecutor of the International Criminal Court. This area, related with the proprio motu powers, their limits and practical realization, was the most controversial during the Rome diplomatic conference in 1998. In the article the Author analyses the concept of the proprio motu, its content and relation among Articles 15, 18 and 53 of the Rome Statute. These issues are significant for the determination of the limits of the prosecutorial discretion and has determinant influence on the triggering of the jurisdiction, on the procedure of admissibility of the situation and therefore on the overall procedure of the International Criminal Court. Moreover, the Article deals with possibilities of the judicial control of the prosecutor and analyses practical examples of the prosecutorial inactivity.
