Abstract [eng] Commercial extraction of the unconventional hydrocarbons in the U.S. as well as prospective extraction of the shale gas (which is one of the uncoventional hydrocarbons) in some of the EU Member States posed a question whether the current environmental legislation is sufficient to ensure high level of the environmental protection. In addition, having regard to the transnational nature of the environmental impact of the shale gas exploitation activities, this issue is better analysed at the EU rather than national level. The analysis of the discussion on the existing EU environmental law applicable to the shale gas exploitation activities is overviewed in the article: main threats to the recommendations on its further improvement arepresented. Moreover,theexistingenvironmental EU legislation is analysed in order to ascertain if it is sufficient to ensure high level of environmental protection. The analysis is based on the studies and recommendations issued by the international, European and national institutions and organisations, as well as on the Resolution of the European Parliament of 21 November 2012. Author makes a conclusion that although there is no necessity to adopt EU legal act governing shale gas extraction, both the EU and national environmental legislation applicable for the extraction of the shale gas has to be adjusted in order to ensure high level of environmental protection.
