The overlapping of imperative and dispositional judicial regulation means as an expression of compromises and (or) noncompromises in a social system is dealt with in this article, using understanding of law as on of social norms systems, undergoing confrontation, conflicts or seeking compromises. On the basis of examples of the Lithuanian law of the present day the invasion of both regulation methods into public and private law, not regulated tradicionally by them, is pointed; the problem of the lack of argumentation of linked to potentiol threat to the balance of the judicial system is ruised. |
