This article investigates the impact of peremptory norms on State immunity assertions and analyses whether the breach of a jus cogens norm result the loss of immunity of the state or its representative alleged to have violated this norm. Also in this article is raised the question whether State acts that violate jus cogens norms can be regarded as acta iure imperii and granted immunity. |
