The objectives of public procurement are usually disregarded in legal regulation which typically is brief and sketchy on this theme. Most often legal rules are oriented towards the regulation of public procurement procedures and their implementation. However, this line of action is not wise, since without selecting and framing the legal goals there is no chance to expect for the best outcome. Thus, this article seeks to explore the possible public procurement (system) objectives and to examine the national as well as the EC case-law on their implementation. |
