Abstract [eng] |
Article analyses one of most arguable issues of EC regulation on GMOs, namely right of member states to adopt safeguard measures on GMOs authorised at EC level. Firstly the concept of precautionary principle in the context of GMO legal framework is analysed. Further the case-law of the ECJ on member states’ safeguard measures is evaluated in the light of WTO Panel report on EC Biotechnology regime. Based on this evaluation it is analysed whether member states are still entitled to adopt safeguard measures on GMOs based on precautionary principle. |
