| Abstract [eng] |
The article presents a conceptual analysis of the limits of the impact of the European Convention on Human Rights on the Lithuanian constitutional jurisprudence. In analysing different modes of the internalisation of the Convention, one also reveals how formal legal status of the Convention pertains to its real impact performed on the constitutional jurisprudence. In analysing permissible limits of the said impact, the question of inadequacy of hierarchical monist construct of national legal system is raised. |
