This article provides analysis of one of the most complicated doctrines used by the Court of Human Rights in its case law – the doctrine of the margin of appreciation. Analysis presents findings on chronological (historical) application of the doctrine and conceptual basis for the application, as well as identifies elements and tests used by the Court determining the scope of the doctrine. It also gives critical views on the doctrine per se and its inconsistent application. Everything is summarised by constructive conclusions. |
