Sources of Lithuanian Law. Changes since 1990 Since Lithuania restored its independence on 11th of March, 1990 and regained the sovereignty, it faced a task of establishment of legal system of Republic of Lithuania as a result of destruction of its legal system made by Soviet Union which then forced Lithuania to adopt soviet legal acts. On this basis it is necessary to review what changes of sources of Law have happened and discuss changes of sources of Law possible in the future. To make it clear what changes are going to be analyzed in this final master thesis there are given definitions of source of Law adopted by Soviet Union and Lithuania as well as classification of sources of soviet Law and Lithuania, compared which it comes to conclusion that there are more sources of Law of Republic of Lithuania than of soviet law. In this final master thesis is revealed the significance of establishment of Constitution of the Republic of Lithuania as of supreme law which is also related to establishment of constitutional acts, legal precedent, constitutional jurisprudence and official constitutional doctrine in the system of sources of Law of the Republic of Lithuania. As far as legal science of Lithuania and legal science itself were ceased for the period of soviet occupation and since Lithuania restored its independence there were made circumstances to continue the development of legal science, in this final master thesis is specified the meaning of legal science in the system of sources of Law of the Republic of Lithuania. Decisively agreeing that rules of international law have made some impact to the Lithuanian Law, in this final thesis are analyzed international law and law of the European Union as elements of the legal system of the Republic of Lithuania. After all, regarding to that processes of globalisation have caused the establishment of ideas of legal globalisation of some scale, in this final master thesis is also discussed the possible establishment of the theory of universal law. |
