This thesis work examines the compensation peculiarities for the damages caused by improper maintenance of the common partial ownership objects in apartment buildings. The practical relevance of the topic can be seen in ordinary life situations where the damage is caused due to improper maintenance these objects by the owners. The theoretical relevance of the thesis topic arises when the court, has to resolve the systematic application of several civil law institutes all together in order to make a lawful and fair decision caused by above mentioned circumstances. The analysis of this thesis topic yet has not been fully solved neither in the law doctrine, legislation or the other thesis works. There are still relatively a lot of unsolved practical and theoretical problems. The analysis of the topic that was done in this thesis is considered to be useful both on a practical and theoretical level and contributes to the formation of a clearer law doctrine and legislation on the issue. The analysis is made by discussing the legal institutes relevant to this civil legal relationship, by mentioning all the necessary legal constructs and further on moving onto resolving the most common practical problems that are caused by practical life situations. In this thesis work there were used special and informative literature on the topic, Constitutional Court doctrine and the practice developed by the Supreme Court of Lithuania to get all the needed answers how to solve occurring practical and theoretical problems. |
