The law of inheritance is relevant from the earliest times to the present day. Although most of the regulatory norms in Lithuania are imperative, there are still some uncertainties in practice. This Master's thesis examines the institute of inheritance by comparing regulatory norms of Lithuania and foreign countries, moreover aims to raise the main problems and compares and finds solutions to these legal systems. The first part of the Master's thesis analyzes the influence of Roman law on modern legal systems and describes institutes that operate in Lithuania and foreign countries to this day. It also briefly describes the evolution of inheritance from the first statutes to the laws of the Soviet era. The second part of the Master's thesis describes the institute of inheritance: its concept and legal systems. The thesis analyzes terms, as well as their calculation procedure. Possibilities of renewal and problematic aspects are compared with foreign law, explaining whether it contains more precise regulation. Thesis also describes the ways for acceptance of inheritance and the responsibility of the inheritors for the heir's debts by comparing the inheritors liability to systems of limitation in foreign countries to Lithuania's legal requirements. All types of inheritance are analyzed in more detail, likewise judicial and notarial practice and regulations in foreign law are compared, and the assessment of these systems is provided. |
