This master thesis examines the relation between geographical indications and trademarks, focusing on disputes between these marks and possible methods concerning their settlement. The aim of the master thesis is to examine the relation between geographical indications and trademarks, the resulting disputes between geographical indications and trademarks and the main ways to solve them. The material gathered during the study aims to identify issues arising from major dispute between geographical indications and trademarks resolution methods and to propose measures to resolve it. The master thesis is divided into three separate parts according to the issues they deal with in order to properly identify the problems arising from the relation between geographical indications and trademarks, and in particular the dispute resolution between these marks, to fully analyze them and provide solutions to the problems identified. The first part of this master thesis deals with the conceptions of geographic indications and trademarks: the origins of the protection of these marks, the concepts of geographic indications and trademarks, regulation and the peculiarities of protection provided. The second part of the master thesis examines the similarities and differences between geographical indications and trademarks. Such a comparison helps to determine at a later stage which of the dispute resolution methods between geographical indications and trademark are the most appropriate in the light of the degree of similarity between the marks in question. The third part of the master thesis reviews disputes that arise in practice between geographic indications and trademarks, assesses the main ways of solving such disputes and, taking into account the identified problems of specific dispute resolution methods, formulates suggestions for the elimination of shortcomings of dispute resolution. After examining the main ways of resolving disputes between geographical indications and trademarks, as well as emerging issues, conclusions and generalizations are provided. |
